01. Eligibility & Account Registration

To use certain features of our website or mobile app — including submitting enquiries, placing orders, or registering an account — you must:

• Be at least 18 years of age.
• Be legally capable of entering into a binding contract under Indian law.
• Provide accurate, current, and complete information.
• Maintain the confidentiality of your account credentials.
• Be responsible for all activities that occur under your account.

You agree to notify us immediately of any unauthorised access to or use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for an extended period.

02. Acceptable Use

You agree to use our website, app, and services only for lawful purposes. You must not:

• Use the platform in any way that violates applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the platform, server, or related infrastructure.
• Introduce viruses, malware, or any harmful code.
• Engage in scraping, data mining, or automated extraction of content without our written permission.
• Impersonate any person or entity, or misrepresent your affiliation.
• Submit false enquiries or fraudulent orders.
• Send spam, harassment, or unlawful communications.
• Reverse engineer, decompile, or disassemble any part of our mobile application.

Violation of these terms may result in immediate termination of access and legal action.

03. Products & Service Engagement

Emerald Enterprises provides the following products and services:

• Manufacturing, supply, installation, and commissioning of portable and fixed biogas plants.
• Supply and installation of solar panels and solar water heaters.
• Design, manufacturing, and delivery of FRP boats — speed boats, pedal boats, row boats, and kayaks.
• Manufacturing of FRP doors, fish tanks, water tanks, and custom fiberglass products.
• Post-installation maintenance, repair, and after-sales support.

Engagement typically follows this process: enquiry → consultation → site assessment (where applicable) → quotation → written confirmation and advance → manufacturing or procurement → delivery and installation → handover with warranty → after-sales support.

04. Product Information & Availability

We make every effort to ensure that product descriptions, specifications, dimensions, capacities, images, and prices on our website and app are accurate. However:

• Product specifications, designs, and availability may change without prior notice.
• Colours and finishes shown in photographs may vary slightly from the actual product due to display and lighting differences.
• Customised products (custom-sized boats, biogas plants of specific capacity, etc.) are manufactured to order based on agreed specifications.
• We reserve the right to limit quantities, refuse orders, or discontinue any product at our discretion.

Any technical drawings or brochures shared during the enquiry stage are indicative. The final binding specification is the one set out in the signed quotation, purchase order, or installation report.

05. Pricing, Payment & Taxes

All prices are in Indian Rupees (INR) unless otherwise specified.

• Prices are subject to change without prior notice. The price applicable to your order is the one confirmed in writing in the final quotation or invoice.
• Applicable GST and other government taxes are charged as per prevailing rates.
• Delivery, installation, and commissioning charges (where applicable) are quoted separately.
• For made-to-order and customised products, an advance payment of 50–70% is typically required to commence production, with the balance due before dispatch or installation.
• Payment may be made via bank transfer (NEFT/RTGS/IMPS), UPI, cheque, or through approved payment gateways.
• For mobile app transactions, payments are processed by third-party payment processors. We do not store full card or bank details.

Late payments may attract interest at 1.5% per month or the maximum rate permitted by law, whichever is lower.

06. Orders, Cancellation & Refunds

An order is confirmed only when we issue a written order acknowledgement or invoice.

Cancellation

• Standard products in stock: may be cancelled before dispatch with a full refund of the advance, less a 5% administrative fee.
• Customised / made-to-order products: once production has commenced, cancellation may result in forfeiture of part or all of the advance, proportional to work completed.
• Installation services: cancellation within 48 hours of scheduled installation will incur a site-visit charge.

Refunds

• Approved refunds are processed within 7–14 working days to the original payment source.
• For app-based digital purchases (if any), refunds follow the policies of Google Play Store or Apple App Store, in addition to our policy.

Returns & Replacement

Physical products may be returned only in the case of manufacturing defects identified at delivery or during the warranty period. Returns must be reported within 7 days of delivery. Custom-built products are not eligible for return unless they fail to meet the agreed specifications.

07. Delivery & Installation

Estimated delivery timelines (good-faith estimates, not guarantees):

• Standard portable biogas plants: 7–15 working days from order confirmation.
• Fixed / large-capacity biogas plants: 30–60 working days, depending on scope.
• FRP boats: 15–45 working days, depending on size and customisation.
• Solar systems: 7–21 working days, subject to panel availability.
• FRP doors and small items: 7–14 working days.

We are not liable for delays caused by force majeure (floods, storms, pandemics, government restrictions), supplier delays beyond our reasonable control, transportation disruptions, or customer-side delays (site not ready, permissions pending, payment delays).

For installation services, the customer is responsible for providing safe and accessible site space, obtaining local permissions or NOCs, ensuring utility connections, and designating a responsible person to receive the goods.

08. Warranty

Our products carry warranties specific to each product type:

• Biogas plants: as specified in the installation document (typically 1–5 years on the digester structure).
• Solar panels: manufacturer warranty as per panel make (typically 10–25 years on power output).
• Solar water heaters: 5 years on the tank, 1 year on electrical components.
• FRP boats: 1 year on hull workmanship; engines and accessories covered by respective manufacturer warranties.
• FRP fish tanks: up to 10 years on the tank structure.
• FRP doors: 2 years on structural integrity.

Warranty does not cover damage caused by misuse, neglect, accidents, natural disasters, unauthorised modifications, or use outside intended operating conditions. The detailed warranty card supplied with each product takes precedence.

09. Mobile Application Terms

If you download and use our mobile application from the Google Play Store or Apple App Store, the following additional terms apply:

• This agreement is between you and Emerald Enterprises only — not with Google or Apple. Google and Apple are not responsible for the app or its content.
• You agree to comply with the Google Play Terms of Service and/or the Apple Media Services Terms applicable to your download.
• You will only use the app on a device that you own or control, in line with platform usage rules.
• You will not use the app in any way that violates the platform store policies.
• Google and Apple are third-party beneficiaries of these Terms and have the right to enforce them.
• The app is provided free of charge unless explicitly stated otherwise. We do not currently offer paid subscriptions or in-app purchases.
• You may delete your account at any time through the app settings or via our Data Deletion Policy.

The app may be updated from time to time. You are responsible for keeping the app updated to receive bug fixes, security patches, and new functionality.

10. Intellectual Property

All content on our website and mobile applications — including logos, trademarks, text, images, photographs, videos, illustrations, product designs, technical drawings, software, and the overall look and feel — is the exclusive property of Emerald Enterprises or its licensors and is protected under Indian and international intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any content without our prior written permission. You may not use our trademarks, brand name, or logo in any manner that suggests endorsement or affiliation, nor remove or alter any copyright or proprietary notices.

11. Disclaimer & Limitation of Liability

Our website, app, and online content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no representations or warranties regarding the uninterrupted, secure, or error-free operation of the platform.

To the maximum extent permitted by law, Emerald Enterprises and its directors, employees, agents, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, goodwill, data, or business opportunities.
• Damages resulting from unauthorised access to your account or data, despite reasonable security measures.
• Damages arising from third-party services, links, or content.
• Damages caused by force majeure events.

Our total aggregate liability for any claim shall not exceed the amount you paid to us for the specific product or service giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law (e.g. liability for death, personal injury, or fraud). Your statutory rights under the Consumer Protection Act 2019 are always preserved.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or our services shall be:

1. First attempted to be resolved amicably through good-faith discussions.
2. If unresolved within 30 days, referred to mediation in Kochi, Kerala.
3. Failing mediation, settled by arbitration under the Arbitration and Conciliation Act 1996, with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Kochi, Kerala, and proceedings shall be conducted in English.

Subject to the above, the courts of Kochi (Ernakulam district), Kerala, India shall have exclusive jurisdiction.

13. Changes to These Terms

We may revise these Terms from time to time. The updated version will be posted on this page with a new "Last Updated" date. For material changes, we will provide additional notice via email or in-app notification (where applicable).

Your continued use of our website, app, or services after the changes constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using our services.
